On July 18, 2019, the Federal Energy Regulatory Commission (“FERC” or “Commission”) issued Order Nos. 860 and 861, in which FERC revised the requirements for sellers authorized or seeking authorization to make sales of energy, capacity, or ancillary services at market-based rates (“Sellers”).

Jul 1, 2020 · The order requires entities with or seeking market-based rate authority (sellers) to submit certain data related to FERC’s market power analyses, including its indicative screens and asset appendices, into a “relational database” maintained by FERC.

Jun 25, 2021 · FERC has delayed implementation of Order No. 860's requirements several times. Currently, the Order is scheduled to go into effect on July 1, 2021, but there is a transition period until November 2, 2021.

On August 19, 2021, the Commission issued an Adopted Revision of Information Collection, which modified the reporting requirements established in Order Nos. 860 and 860-A to collect additional data from certain MBR Sellers.

The MBR Database was adopted by the Commission in Order No. 860, as modified in Order No. 860-A, issued on February 20, 2020, and by Order Adopting Revisions to Information Collection, issued on August 19, 2021. As the Federal Energy Regulatory Commission (FERC) considers changes to Order No. 860 requirements, it has now delayed the order’s effectiveness for three months to July 1, 2021, and in so doing, it has clarified its definition of “Affiliate” for market-based rate (MBR) purposes.
